Retrieving your file from a Solicitor's office?

Is it possible to request your file (or a copy of it) from your solicitor without having received their bill yet?

Ask them if you can have a look at the file and get copies of the contents. They might be ok.

Thanks for the response, but what I want to know is if a client is entitled to this, not if the solicitor is 'ok' with it or not? We are having problems with the solicitor and need to seek alternative legal advice on the case.

It is your file, and in my opinion, it should be returned to you forthwith.

However, it is common practice for solicitors in Ireland to hold files against their client's will, and use it as a ransom untill all monies deemed to have been owed to them by their client are paid in full. This being required whether or not your solicitor has carried out your instructions to your satisfaction.

Furthermore, I believe that the Law Society, and any other solicitor or politician that you may find, will not help you in your plight.

For a classic example of this bad practice, have a look at the listing about the crooked solicitor Mr John Hussey, Fermoy, Co. Cork on the Rate Your Solicitor site.

Regards, Setanta.
