The Law Society looks after its own!!!

The following notes below are a selection from our dealings with Adrian P. Bourke, a Ballina, Co. Mayo solicitor and ex-president of the Law Society.

1. The Law Society made their decision of "inadequate professional services" against Solicitor Adrian P. Bourke in February 2007.

2. As part of their decision, all professional fees charged by Adrian P. Bourke were refunded to the estate.

3. Delays in paying taxes resulted in Adrian P. Bourke paying substantial penalties and interest to Revenue.

4. The Law Society sympathised with Adrian P. Bourke, their ex-president, in making their decision saying "due to your medical health, your financial loss suffered and the adverse publicity in this matter, the Committee would not make any further direction".

5. The Law Society did not ensure that the administration of the will was completed accurately and in full.

6. Serious errors were made by Adrian P. Bourke in his administration of the will, for example, a sum of money was due to be paid to the Parish Priest at the time of the person's death for masses. We received a receipt signed by the a different Parish Priest as a legacy. There was no mention of masses and the Parish Priest at the time of the person's death had retired. The person who died never knew the person who received the money and no evidence was produced to show the masses were said.

7. We stated this to Adrian P. Bourke at the time but naturally due to his incompetence, inability to process a simple will and long delays, the money was paid to the wrong priest.

8. The Law Society ignored this serious error in making their decision.

Waste of time complaining to these boys.

But it is advisable to do so anyway as there will come a time when we need to show we exhausted all avenues in this domestic authority.


Justice must not only be done, but must be seen to be done!'.

Changes to the Complaints System

Most people are fully satisfied with the service they receive from their solicitor. Occasionally, there is a problem and a complaint is made.

The system for making complaints against solicitors changed with the opening of the Scottish Legal Complaints Commission on 1 October 2008. From that date, all complaints must be sent to the Commission in the first instance.

It decides if a complaint relates to a service provided or the conduct of a solicitor and whether the Commission or the Society or both should investigate the matter.

Time Limits

It is always best to investigate complaints as soon as possible after the event, when memories are fresh and paperwork is intact and available. The Society and the Commission investigate complaints made within a year of the business being completed or the matter coming to the complainer's attention. The Society's time limit is only relaxed in very exceptional circumstances.

I contacted them as soon as the matter came to my attention- but they did nothing.
