31st of May, 2007 The two senior partners in this partnership have failed to explain more than E95,000 of expenses in 'The Maher Case', Castledermot. They have also failed to account for 4 years income from the estate. They also withheld more than E150,000 for more than 5 years and have failed to provide any legal reason as to why they withheld this money. This firm of solicitors would not be allowed to do this in any other western country. This firm has now threatened proceedings against Michael Maher, Plunketstown, because they are being exposed on rateyoursolicitor.com. A previous senior partner, John Aylmer, initially handled The Maher Case. He failed to hand over the proceeds due to Michael Maher on completion of the sale of his uncle's estate, despite the fact that he and his partner FRANK LANIGAN both signed a letter saying the money would be handed over 'on completion' of the sale. The previous partner, John Aylmer, is currently involved in a High Court case against Malcomson Law. The case has now been running more than 4 years. 22nd of Jun, 2007 If you leave your house to your son or daughter, Malcolmson Law can give you a big list of expenses and refuse to give you receipts for those expenses, like they have done in the Maher Case, Castledermot. The Law Society will do nothing, just like they have done nothing in the Maher case, despite being presented with an expense account from Malcolmson Law with no details in the particulars column for 95,000 expenses. A total of about 300,000 expenses with no receipts, 95,000 which had no particulars. How would you like if your bank listed expenses of 300,000 for things and refused to explain 95,000 of those. Imagine also if the Banking Ombudsman told you you are entitled to 'accounts and nothing more'. No receipts, and no confirmation that those were legitimate expenses. Would you continue using that bank? Would you tell your friends about your experiences at that bank? Would you recommend that bank? All this can be confirmed with copies of letters. How would you like if you sold your house and the solicitor held your money for 5 years without any legal reason?
22nd of Jun, 2007 Does anybody know how to get receipts for about 300,000 Euros from Malcolmson Law? Michael Maher has already asked and they have refused. If anybody thinks Malcolmson Law will give receipts to Michael Maher, can they go along with Michael Maher to ML, and ask for those receipts? Michael Maher would greatly appreciate your help and he is sure you will appreciate that seeing and trying is believing! Michael Maher would love to know who they gave the money to. It isn't very often that someone doesn't account to a residual beneficiary for approximately 300,000 Euros. It is quite funny, but not for Michael Maher.

12th of Jul, 2007 M.M. They oversaw the devaluation of an inheritance by 80%. It had an original value of 50 acres, and by the time Malcolmson Law were finished with it, it had a value of 10 acres. They did this in the period from 2000 to 2006. Few other people or businesses in Ireland oversaw the devaluation of an asset by 80% in this period. Documents are of course available to support this.
7th of Aug, 2007 Michael Maher They (ML) were the administrators of the will of Michael Maher, Corballis. Threatened the beneficiary that the only way they saw of executing the will was if the beneficiary sold land at well below market value to his brother, Eamon Maher, Castledermot. Malcolmson Law said the suggestion came from Eamon Maher, Castledermot, who was an executor of the will and refuses to account for in excess of 100,000 Euros from the estate of his uncle. Documents are of course available to support this.

The guidelines published on official goverment websites say the esate should be finalised within 1 year. 10 years and Frank Lanigan has failed to finalise the estate. Is Frank going for the record of incompetence? Frank Lanigan has provided Michael Maher, the nephew of the deceased, with no legal reason for the delay.

They have a well known history of bullying their staff and most good honest career minded young solicitors left before they were forced out. Ask any solicitor elsewhere. Lots of them suffered the wrath of the crazy Frank Lanigan and his mysterious ways. Even Mary Martin our fine local judge knows damn well that Lanigan is nothing but an angry 55 year old mouth in a suit.

22nd of May, 2008 Michael Maher John McGuinness, junior minister, asked Michael Maher to not protest against Fianna Fail before the last election, and gave him the impression he would do what he could to help. He has recently indicated to Michael Maher that he will not help him. Michael Maher does not like being conned by a Fianna Fail minister. Michael Maher would like to remind people that he warned people about the solicitor son of a former minister. That solicitor son is Harry Colley, son of former minister George Colley. Harry has now been barred from practising for three years. Michael Maher will write to John McGuinness again to seek help. Details of the response to that letter will be published. Another Fianna Fail minister is also now involved. His name is Brian Lenihan. His response is quite incredible. Details to follow.
2nd of Sep, 2008 Michael Maher Still waiting for definitive full and final accounts for my uncle's estate more than 11 years after they took out probate. Frank Lanigan and his partner Raymond Bradley refuse to supply such. They withheld more than 150,000 Euros for more than 5 years and both partners have failed to give any legal reason as to why they did so. A senior partner, John Aylmer, who was handling the case at the time, retired early after withholding more than 150,000 Euros without giving any legal reason. I, Michael Maher, had to pay tax on money I never received, and the money in question was not received by the taxman nor has it been accounted for by Frank Lanigan or Raymond Bradley. Avoid, avoid, avoid. They currently have the support of Brian Lenihan, and John McGuinness. See Brian Lenihan separately for his involvement in this matter.

14th of Mar, 2009 Sarah Frank Lanigan was on a list of solr. sent to me by Law Society after a complaint about another solr who was subsequently disbarred. What a mistake to go to him He seemed very nice and friendly paid money up front and along the for what I will never know. He blamed the land registry for all the delays about 15 years in all. My marriage broke up we needed our deeds which he had signed out of the bank . As we didnt owe him any money I expected them to be returned . However more than a year later, many visits from both me and ex husband to Carlow with ex husband becoming more and more angry and frustrated, blaming me for the delay our deeds were returnrd. With hind site and the revelations obout rogue solrs I now wonder where were our deeds (it was an un registered property)were they being used without our knowledge?

1st of Nov, 2009 Rory IF YOU BUY A HOUSE AND GIVE MALCOMSON LAW THE MONEY, THEY CAN KEEP THE MONEY --- AND THE HOUSE. This unfortunately is no joke, except to the solicitors who are allowed to do it and the Fianna Fail / Green Party government who do nothing to hold people to account. There have been groundbreaking new legal precedents established with the Bradley, Doyle, & Crosbie / Malcomson Law V Maher case, wherein MALCOMSON LAW APPLIED TO HAVE MAHER DENIED HIS CIVIL RIGHTS UNDER THE LAW. Paragraph 3.2 of the interim judgement in that case states “It seems equally clear that any entitlement to trial by jury in defamation proceedings is purely statutory, and does not derive from the Constitution”. The judge went on to deny Maher a jury. The full text of the judgement can be found at www.courts.ie/Judgments.nsf/09859e7a3f34669680256ef3004a27de/21a822f32fc97c6c8025763500510625?OpenDocument. This effectively means that a judge can ignore any statutes (laws) enacted by the Dail. There is nothing in the Irish Constitution that says you are entitled to a house after you pay for it. The judgement handed down by Justice Frank Clarke may be the first of its kind in the world. It will be interesting to see if anyone can find any precedent for this type of judgement anywhere else in the world. If you think the Law Society will do anything, forget it. They derive their authority from the Fianna Fail led government, and Fianna Fail have a long history of corruption, and failing to provide proper regulation. Can you honestly believe Fianna Fail will hold people to account when they are unlikely to receive the necessary political campaign donations from honest people? By taking no action against people involved in corruption and malpractice, those people involved in corruption and malpractice are left with more money available to donate to Fianna Fail, and to keep the Fianna Fail circus government in power.

We read about China, Zimbabwe, Afghanistan, Mymar, and other places where human rights are being violated, but is Ireland any better? Our President and ex president go around promoting human rights, but of course when rights are denied in Ireland does anybody say or do anything? Of course not!

The article says that Maher published the allegations about Malcomson Law on the website Rate Your Solicitor. Is Maher saying that the allegations by him on this website are not defamatory? 29th of Sep, 2009 Very Confused I read the article about the Malcomson Law defamation action in the Sunday Business post of the 27th of October. I am a little confused. The article states that Maher has been refused a jury by the judge. It also states that the judge said that Maher had a right to a Jury trial. Can anybody explain to me why Judge denied Maher a Jury trial while at the same time stating that Maher had a right to a Jury Trial?

If a judge tells somebody they have a right to a jury trial and at the same time tells that person that he is not getting a jury trial, then I think our system is deeply flawed, or deeply corrupt. I saw the comments from Raymond Bradleys friend, claiming that Raymond has all the right connections. It would appear that that may be the case.
17th of Sep, 2009 Matt I worked for in Anglo Irish Bank from the early 70’s. In return for lodging money with Anglo Irish Bank, Anglo would give a free loan to the solicitor. This was possible because the banks could lend out 10 times what they took in as deposits. With deregulation, introduced in the early 80’s, banks could lend out 20 or more times what they took in as deposits. Banks could now lend out a free loan to not just the solicitors, but also to the politicians who had enabled this to take place. Politicians could now turn a blind eye to solicitors keeping clients money without reason, as the politicians could now benefit from free loans which were enabled by the solicitors withholding money without reason. Malcomson Law have been withholding money from clients without reason for years, and will continue to do so because the Fianna Fail politicians are personally benefiting from this, and using this illegal money to finance their election campaigns or to use otherwise. Money illegally obtained through solicitors and Fianna Fail politicians has been used to put the current government in power, with all the repercussions that it entails.

6th of Oct, 2009 Solicitor It is believed to be the first time a defendant has been refused a Judge in High Court Defamation proceedins, although there was a case recently where a Kilkenny woman. Lavinia Kerwick, was refused a jury in the High Court. However she was a Plaintiff. The Supreme Court has ruled on many occasions that a Judge has no authority to refuse a jury in a High Court defamation case.
7th of Oct, 2009 Phil Here is the aricle that appeared in the Sunday Business Post of the 27th of September. --- Defamation case to be heard without jury. A Carlow solicitors firm has won its high court battle to have a defamation action heard without a jury. Raymond Bradley, Terence Doyle, and Patricia Crosbie, practising as Malcomson Law solicitors, claim they were libelled and slandered by Michael Maher. They are also seeking an order preventing Maher from continueing to picket and distribute leaflets outside the firms premises in Court Place. Maher made allegations against the firm in relation to his late uncles estate. He is counterclaiming for damages for negligence and breach of fiduciary duty. Maher published the allegations about the firm on the Rate Your Solicitor website. It is alleged he encouraged site visitors to tell him when the firms solicitors were attending court so he could mount a picket. He allegedly published details of solicitors home addresses and cars. Last October, Malcom Law obtained an interlocoutory injunction restraining Maher from making comments on the website and from picketing the solicitors premises. The firm served a notice of trial by a judge sitting without a jury. Maher asked the high court to set aside the notice, claiming that he was entitled to a jury trial, at least for the defamation aspects of the proceedings. Mr. Justice Frank Clarke, in his judgement, said that, in the ordinary way, a High Court defamation claim would be heard by a judge and a jury, whereas a claim for damages for unlawful picketing and an injunction arising out of the picketing would go into the chancery list. He said Maher’s counterclaim would ordinarily be heard by a judge sitting alone, but there was ‘a real risk that there would be a substantial overlap’ between evidence relating to the defamation proceedings, and the evidence relating to the counterclaim. ‘Where a single set of proceedings involves more than one cause of action, the court has to exercise a discretion as to the appropriate way in which all issues in the case can be disposed of’, he said. A separate trial of the defamation issues would involve “a considerable waste of time and parties’ expense in having to go through the same evidence again”. Clarke said the joinder of the defamation and picketing aspects of the case was not a device to deprive Maher of his right to a jury trial, as both aspects of the claim were “real, connected and proper to be decided in one set of proceedings” “The only fair and just way of resolving all of the issues between these parties is by a single trial and, for the reasons which I have already set out, such a trial must be a trial without a jury,” he said.

29th of Oct, 2009 Redmond Why do the Law Society turn a blind eye to these people? Fianna Fail get/got 8,000,000 (Million Euro) from sources unidentified. The Fianna Fail led government is responsible for seeing that officers of the courts are properly regulated. This is one of the most fundamental jobs of any government, and I doubt there are many, if any, countries in the world where solicitors are allowed to get away with what they get away with in this country. Why would Fianna Fail ensure that solicitors are regulated, when it would mean that solicitors would have less money to donate to Fianna Fail in power and keep the establishment in power? The lack of regulation of the legal profession has been brought to the attention of John McGuinness, Brian Lenihan, Dermot Aherne, Mary White, and other members of the Green Party. This was done by Michael Maher, and many others. The first four people have all acknowledged Michael Maher’s letters or emails, while the other Green Party members have not. However nothing has been done. Remember Michael Lynn, the 100 Million owed the banks, and Thomas Byrne, and the guy who was Minister of Justice at the time, initials B.L? How much more money will be borrowed by the Irish taxpayer to bail out banks who have been stupid enough to be conned by malpracticing solicitors? How much more money will B.L. authorise to be borrowed in the taxpayers name because B.L. failed to do his job, and his successor Dermot Ahearne fails to do his job, of ensuring solicitors are properly regulated? I believe that all these politicians would be quite at home in any banana republic, as I am sure they feel quite at home in this banana republic. With politicians like these, it is no wonder that the IMF will shortly be arriving, and then Fianna Fail will be able to blame everything on the IMF, and most people will probably be naïve enough to believe them. What a circus, or perhaps it is more like a zoo.

Now that Fianna Fail can no longer borrow money in the name of taxpayers and their children and grandchildren, to bribe the electorate, they need to raise money to pay for all their advertising which they will need to do to get re-elected. Where better to get that money than from solicitors and others who are still allowed to keep their snouts in the trough while the rest of us are told to tighten our belts.

21st of Oct, 2009 Redmond 30 acres for 10,000 Punts. Malcomson Law told Mr. Maher that they saw no way of giving him the inheritance from his uncle if he did not agree to sell 30 acres to their client for 10,000 Punts. Their client was Eamon Maher, and the fax was sent from Malcomson Law and from the offices of Millet and Matthews in Baltinglass, where Eamon Maher’s wife worked at the time. I have heard that the originals of both faxes and the letters will be produced at the trail of the vindictive case initiated against Maher by Raymond Bradley, Terence Doyle, and Patricia Crosbie, practising as Malcomson Law. Brain Lenihan, and Dermot Aherne, ministers of Justice failed to take any action to ensure solicitors are held to account, despite being written to by Michael Maher and being told that the Law Society were failing to investigate complaints. In view of Lenihans track record as Minister of Justice, do not be surprised if the Banks are not held to account. Michael Maher was given a reason as to why Malcomson Law withheld 150,000 for 5 years, as above, and Mr. Maher does not agree with reports that suggest he did not receive a reason. Maher always claimed he received no legitimate reason. Michael Maher does not know if Eamon Maher offered money to Malcomson Law to get him the 30 acres for 10,000 Punts. The reader is welcome to draw their own conclusions.

How long would I have to be a client for Raymond Bradley or someone else at Malcomson Law to be able to get 30 acres for 10,000? Are there any strange catches? I had heard about the solicitors, but having read about the judgement, makes one wonder, doesn’t it?

The Succession Act 1965, Section 50 (1), states “ The personal representatives may sell the whole or any part of the estate of a deceased person for the purpose not only of paying debts, but also (whether there are or are not debts) of distributing the estate among the persons entitled thereto”. Malcomson Law were the personal representatives of the estate of Michael Maher, deceased. Malcomson Law then withheld 150,000 Euros from Michael Maher for more than 5 years. Their reasons, when presented in court, should raise at least a few laughs. There is also money from Bank of Ireland accounts unaccounted for, income unaccounted for, Inland Revenue High Court Affidavits with false information, and other matters which Malcomson Law have failed to deal with. The executor of the estate, Eamon Maher of Plunketstown, Castledermot, has failed to deal with the above matters. Question also remain as to why the Inland Revenue High Court Affidavits with false information appear to have been signed by Eamon Maher and witnessed by Paula Fleming, who it appears was a solicitor at MLaw. Were they aware of the false information on the Affidavits? Michael Maher has recently become the first person to have his right to a jury denied to him in a High Court action for defamation. The blacks in America achieved their civil rights in the 1960’s, and one can wonder when will Irish people get their civil rights in the Republic. Malcomson Law, as well as not administering the estate in accordance with Law, signed off the badly drafted will of Michael Maher, deceased. Was it purposely drafted badly to ensure higher fees for MLaw? A copy will be published here shortly, along with details of how to see the errors. Warning to anybody using Malcomson Law or their staff: the partners at this Law Firm think they are beyond the Law. Malcomson Law have issued vindictive proceedings against Michael Maher in order to prevent Maher from exposing the malpractice of Malcomson Law and successive partners.

Despite what Mr. Brian Lenihan may tell people, money is no longer safe in Irish Banks, at least not from malpracticing solicitors. Brian Lenihan was advised that solicitors were not being held to account. Brian Lenihan did the same thing as he now does – holds nobody to account and does not see that people are regulated. Michael Maher told many people this about Lenihan. The establishment do not want Michael Maher’s story told, just like many other things in Ireland that they do not want people to know about. Dermot Aherne is no different, in failing to act to see that people’s assets are protected, by failing to take measures to ensure solicitors are regulated.

If the solicitors involved fabricate evidence against me to get me jailed for a crime I did not commit, then I believe it is the solicitors and the authorities who will be in even bigger trouble than they are in now. In most countries, the people who commit the fraud are sent to jail if convicted, not the victims. However, I am well aware of how corrupt the authorities in Ireland are, but I believe even they might think twice as I am sure they do not want outsiders to realise how corrupt Ireland is.

Did they donate some of it to Fianna Fail to turn a blind eye to their misdemeanours? Did they give it to some judges to look kindly on their applications? Or did they even give it to some people in the HIgh Court to create false documents and to create false records?

19th of Jun, 2010 Pat Ran across this crowd (Lanigan in particular) in a marital separation case. Both parties had agreed on even split amicable arrangement. ML stirred and threatened and misrepresented and fabricated until the two sides were set fighting - then charged a lot for their "services". Don't know how they sleep at night.
