The judge made the comments after hearing a case taken against McGlynn and others by Bord Failte, to try to reclaim the defrauded money. How come he was not struck off?

17th of Jan, 2008 Solicitors & Auctioneers It is now accepted that both 'professions' need to be independently regulated, and FF have even initiated this despite having so many of each in their rank and file membership. Having close connections in both professions in a small town like Letterkenny is a pure recipe for disaster, and self-regulation did nothing if only to protect such incestuous relationships. Having said all that, there are issues here, and McGlynn (the solicitor) refuses to account for himself. Of course he was so quick to "clarify" the Gallagher case, but not without the benefit of hindsight. In any event he admitted to malpractice by what is commonly referred to as "knowingly entering into a conflict of interests". Any system that allows him to continue to practice is a kangaroo system in its purest form. One would have thought that Ulster had enough of that, only now it is our supposed compatriots in the form of powerful vested interests with illegitimate privileges who are exploiting the general public, and in no small way I might add. I work in regulation so I should know, but in any event people will make their own assessments and they are entitled to the full facts before trusting these people to handle the largest financial transactions in their lives, i.e. selling/buying a house. I am also acutely aware of what is going on with Pierse Fitzgibbon in Listowel and someone might enlighten me as to what the connection is with this firm. 29th of Oct, 2007 John Gill On behalf of supporters and Victims of the Legal Profession, I wish to thank the gracious lady barrister from the English Midlands who we met on the train on our way to Belfast High Court on 24-10-2007 and who took time out to brief us on the way forward in dealing with Sean McGlynn and other crooks before taking them before a Jury. When this gracious lady was asked if she was a practicing Barrister, she said no, I found myself a decent job. For you who have any doubts, if the Supreme Court fails, McGlynn will have to face a JURY.
20th of Jan, 2008 VLPS Tyrone I cut & pasted these 90 words from the 7,090 words of Judge Edward's Judgement: "It is pleaded that the defendants have continued to falsely and maliciously deny that the deceased was the sole legal and beneficial owner of the property and that the plaintiffs are entitled to sell the said property as executors of the deceased's estate, despite repeated requests for the defendants to desist. It is further pleaded that the defendants and each of them have further claimed that the succession laws have no application and that the said bequest to Anton Gallagher should be transferred to his heirs, successors and/or assigns." My comments: In all the cases I attended I have never observed any evidence being given from the witness box by either of the parties involved. I have never heard Elva Gallagher state that Madge Friel was not the owner of the Farm in question. The 'original will' was never produced. Also the 'will of Madge Friel' does not state for Anton Gallagher's use absolutely. There is no 'exclusive clause' in the will. At the time of making the 'will' Madge Friel and Anton Gallagher were both over 80 years of age. Madge Friel was in a Nursing Home because of her advanced age and infirmity, Anton Gallagher was most probably being cared for by his wife and immediate family. Daniel Gallagher was farming all his father's land. How could Anton Gallagher aged over 80 years of age be in any position to farm the land bequeathed by Madge Friel, when he was unable to farm his own land? Land does not farm itself.

The Solicitors Tribunal ordered Sean McGlynn to pay a sum of E5,500 to the Compensation Fund and pay the whole of the costs of the Law Society of Ireland. The Solicitors Tribunal case is specified on page 62 of December 2006 issue of Law Society Gazette.

6th of Dec, 2007 VLPS present at High Court in Dublin I think it's very important for KM to read the replies in the Case Histories about what happened in the court in Dublin. From my own brief experience of the courts in Northern Ireland there was no proper 'hearing of this case'. There was no 'oral evidence' presented in the Four Courts (High Court) and no 'cross examination' of Solicitor Sean McGlynn. It is getting more like a pantomine and the fact that an elderly lady was left for years in a nursing home without a penny for her daily needs is a disgrace apart from all the other shenanigans.

The Gallagher case is a simple matter of "knowingly entering into a conflict of interests" and is punishable, severely at that. My advice to their victims is to mark your position and wait until the new regulatory system is in place. You may well then close them down as such conflict makes their role as solicitor untenable. What of course is alarming here is that Mr McGlynn refuses to detail what he did that he was actually fined for by the Law Society. One would also have to say that involving his wife is playing the sympathy card with native Donegal people who happen to be very modest indeed. All in all, quite simply, IT STINKS! 9th of Dec, 2007 Northern Ireland VLPS Witness at High Court/Four Courts I found it extremely difficult to read all the comments so I 'cut & pasted' the details to a Word document. Lo and behold the word count amounts to 4,594 almost all negative comments. For solicitor Sean McGlynn & Barrister Niall O'Neill it might be 'Nebuchadnezzar Time' of 'The Writing on the Wall'. Reading these accounts reminds me of my mother getting to the truth if one of us (from a large family) were not 'telling the truth' or trying to be 'economical with the truth'. Her favourite saying was "The broth is getting thicker, it will soon be Irish Stew". Hopefully if there is a new REGULATOR for the LEGAL PROFESSION, Sean McGlynn and Niall O'Neill can get sorted out before their IRISH STEW gets any THICKER.

One of you is lying- either you or them, as they have published details that you are corrupt. I think you are all liars, and unless you can sustain your defence, then I am sure people will draw their own conclusions. On a peaceful protest with a large crowd of Victims of the Legal Profession in late 2003 in Cork City we were approached by a gentleman who said and I quote: Ireland has the most corrupt Legal Profession in the civilised world. How true? Sean McGlynn is unable to distinguish between the truth and lies because from day one he was not only protected by his Union in Blackhall Place but by the Circuit Court in County Donegal which was attended by members of the VLPS who witnessed a most appalling scene of corruption and criminal deception against the Gallaghers and two members of another Donegal Family by a Barrister whose story has not as yet come out into the open. Judge John O'Hagan recognised the corruption in open Court but allowed the corruption to continue. Judge O'Hagan later told the Circuit Court in Donegal how he loved coming to Donegal. The abuse of Elva Gallagher by Judge John O'Hagan was that of the bullying tactics of a drunken national school teacher way back in the middle of the last century while he treated the McGlynn crooks with kid gloves. One must ask the question, who has brought the Irish Judicial and Legal Profession into disrepute, the honest people of Ireland or those who sought to destroy them? (the Legal and Judicial Professions). This is only the tip of the iceberg for Sean McGlynn, Catherine McGlynn and the Legal and Judicial Professions. If anyone has a story more rotten than what is happening in the Courtrooms of Ireland today, we would like to hear from them.

It seems incredible that "Sean McGlynn chased the nurse out of the room, which left only husband and wife in the room, which in turn left Madge Friel no choice of Executors". How can this exclusion of a nurse as an independent witness be explained? It all makes for very unsavoury reading if it is true.

Where is the 'Original Will' of Madge Friel? From my reading of the case Sean & Catherine McGlynn attended upon Madge Friel in the Nursing Home. There is no mention of Sean & Catherine McGlynn having typed up the will of Madge Friel during this attendance. Is the 'Original Handwritten Will' of Madge Friel missing? It is all very suspicious.
29th of Oct, 2007 Sean and Catherine McGlynn For those interested (as in the question from "Kyle M" here). 1. Mrs Friel, deceased, was a lovely person. Mrs Friel is cousin of Anton Gallagher, deceased, father of Daniel Gallagher. Mrs Friel lived alone prior to going into a nursing home, without any close relatives. She had a number of nephews and nieces in America who are the ultimate beneficiaries of her wealth. 2. Mrs Friel did acknowledge Daniel Gallagher's father, Anton Gallagher, in her will. 3. Anton Gallagher died shortly before Mrs Friel. 4. At no time in our many years of dealing with Mrs Friel did she ever mention Daniel Gallagher. 5. Mrs Kathleen Gallagher, wife of Anton Gallagher and mother of Daniel Gallagher, was informed by Sean McGlynn very shortly after Mrs Friel's demise of the contents of the will. This was done as a mark of respect for Anton Gallagher and his relatives. 6. Sean McGlynn and Catherine McGlynn accepted this responsibility (to act as executors) because of the respect they had for Mrs Friel and because when Mrs Friel was asked who she wanted to be executors she did not have any preference for any of her relatives. 7. As Judge Edwards rightly pointed out in his judgement, having read the volume of material received from Daniel Gallagher (handed in by his wife Elva Gallagher), Sean and Catherine McGlynn have nothing to gain from this. 8. Since the Circuit Court in Letterkenny when Judge O'Hagan gave his judgement, Daniel Gallagher has not appeared in person on any occasion on the basis that he has a medical condition that precludes him from attending court or from travelling to the court. However, on the occasion of the Appeal Court in Dublin we were informed on telephoning the premises of Mr and Mrs Gallagher that they were attending a conference of the Victims of the Legal Profession - in England. 9. Mr and Mrs Gallagher have asserted all along that we were in collusion with our own barrister, Judge O'Hagan in the Circuit Court, all of the court staff in the Circuit Court in Donegal, the Registrar in the Court of Appeal in Dublin, the Court Registrar in Dublin in the Court of Appeal, and the entire Gardai in Donegal, and the Garda Fraud Investigation Bureau in Dublin. 10. Read the facts and use your judgement wisely.

I have heard Elva Gallagher state in the High Court that Madge Friel did not have a cousin named Anton Friel. Is Anton Friel a 'Fictional Person'? How can a 'Fictional Person' be included in a Will? How much more of this nonsense can the Donegal people take from this wretched numbskull, who in the name of God told him that he was a lawyer. The comments In the main, seem to be from the visible panty line, sorry VLP or whatever. They make a comment - they reply - they answer - they reply. You get my drift. People. Do not be confused. The concern may be genuine, however, the concept of the site is unworkable. 2. The comments are unhelpfull. 3. The conclussions are non-existent. 4. If you, I, or anyone has a genuine complaint, the first person we should go to is the person with whom you/we have the grievance and in the majority of cases, grievences CAN be ironed out. 17th of Jan, 2008 Daniel Gallagher Sean McGlynn says it is good to talk directly to the person with whom you have a legal problem, inviting people to talk and iron out their problems. In the early days I went through another solicitor, the so called "proper channels" we are led to believe, to 'iron-out' our grievances. I can produce a letter dated 27/6/2001 from Sean McGlynn, stating: "We do not see that there is any further necessity for any further correspondence with your client nor yourselves and we do not intend to enter into any such further correspondence". My solicitor commented to me "not only has he insulted you, he has also insulted me". It would appear that solicitor Sean McGlynn says one thing and then does the complete opposite.

Is it no big deal to jeopardise people's lives? The Law Gazette where he was found guilty states: "Through his conduct showed disregard for his statutory obligations to comply with the Solicitors Accounts Regulations and showed disregard for the Society's statutory obligations to monitor compliance with the Solicitors Accounts Regulations for the Protection of clients and the public". Sean McGlynn was acting the same as someone Driving without Insurance and endangering the public, a very serious offence indeed. Is it not?
17th of Jan, 2008 Daniel Gallagher Sean McGlynn gives the names of 3 or 4 people who are not clients of his. They must be very happy people. Madge Friel would not have had the same to say, had he called back to see her again. Sean and Catherine McGlynn have wished everyone a "Happy New Year", they did not allow Madge Friel to have very many "Happy New Years" waiting 6 years in a Nursing Home for Sean and Catherine McGlynn to return with her money, all One Hundred and Thirty One Thousand Euros of it. And this is even with Sean McGlynn testifying in his High Court Affidavits that he had "Enduring Power of Attorney" over the affairs of Madge Friel.

17th of Jan, 2008 John Gill I am the witness who was called to witness what is another appalling obstruction by the Central Office of the Four Courts in the denial of Elva Gallagher to go before the Master of the High Court for directions as per Order 36 of The Rules of the Superior Courts to have Sean and Catherine brought before a Jury. The gentleman who we dealt with did get instructions on two occasions from the Chief Registrar (name unknown), and in my humble opinion the conduct of all and everyone to cover up for the Criminal Deception, Perjury and Mass Corruption of the McGlynn duo must throw another indelible mark on Justice in Ireland when it comes to lay litigants. Donegal people at home in Ireland and all over the world lend a helping hand to rid us once and for all of this cancerous corruption. How can something as simple as drafting a Will (a will that can be bought in Eason's in Foyleside, Derry City for approx £1.50) end up with Solicitor Sean McGlynn having full Legal Power over Madge Friel?? When Solicitor Sean McGlynn drafted Madge Friel's will (he was a complete stranger to Madge Friel), Sean McGlynn suddenly becomes 'Power of Attorney', 'Executor', 'Witness', 'Beneficiary', 'Administrator', 'Personal Legal Representative'??? And conveniently provided his wife Catherine McGlynn as the 'Other Witness and Executrix'. How could all this happen, when all he was requested to do was to make a will for Madge Friel???

15th of Mar, 2008 Re 'John Finnegan', Listowel links, etc. There are claims that VOIS supporters have attempted to link this firm to what happened in Listowel and a previous comment that appeared to come from McGlynn may have given rise to this. McGlynn has since claimed there is no link and VOIS has never claimed to have evidence to the contrary. A further issue is that a public official, who VOIS knows to have a personal and thereby illegitimate vested interest in the crimes by a Listowel based solicitor, has made assertions that the previously mentioned claims were made from a computer linked to the Listowel issue. This is clearly to distract from what they have been up to themselves as anyone who knows what is going on here will know full well. The fact remains though that McGlynn did knowingly enter into a conflict of interests in the Gallagher matter and when you then see that he has also been fined by the Law Society on other issues of malpractice and misconduct, it is hardly a pretty picture. What makes it even worse is that he refuses to address the conflict of interests, so he loses all credibility on the Gallagher case. It does not say much for the likes of 'Finnegan' who claims that High Court papers "completely vindicate the McGlynns" when the very opposite is the truth. One should also look at the "2 simple questions for the McGlynns" comment and where McGlynn got one star, so that sound genuine. So rather than trying to confuse casual visitors to the thread with smokescreens, people should be straight. Until McGlynn answers the conflict of interest issue I am logging an AVOID rating, and I would be delighted if I could give him 3 stars if he can account for his actions. 15th of Jul, 2008 Tyrone VLPS I along with another VLPS person from Tyrone were present today in Daniel & Elva Gallagher's house when Daniel Gallagher was served with another summons (8.15pm) from Sean McGlynn, a 're-hash' of the one Sean McGlynn sent before based on Judge O'Hagan's Order in 2006. The date on Sean McGlynn's letter was 7th July with 7 days to 'get off' land and has only managed to deliver the letter 8 days after the date of the letter, already one day past the deadline.

During the course of his judgement Harman J also made the following observations about will-drafting within the legal profession: "Clients are apprehensive about the fees that will be charged for the drawing of a will... (They are) therefore apprehensive about the fees that will be charged for drawing a will. He said clients are quite pleasantly relieved about the low rate of fees charged because as (one of the solicitors who gave evidence as an expert witness) frankly said to me, solicitors tend to regard instructions for a will as what I, I hope politely, called seed-corn for the future, and he slightly more harshly described as a sprat to catch a mackerel – the mackerel being the administration of the estate which is a notoriously fee-generating occupation. The social desirability that persons should die leaving wills that have been professionally settled and the necessity of limiting the time and therefore cost, of preparing a will point to no duty being imposed by law which will increase the time involved." 11th of May, 2008 A+ Student A human part of this story is why the relations in England did not check to see that the lady in the nursing home was OK, they could have actually helped to look after her and taken her out, even away on holiday. It would appear to me that the solicitors did their job and that the nursing home, which was a private one, did theirs. The lady made her will and her wishes were granted and the people she left her money to must have have been special to her. I am still reading about this case and I will post again if I find anything that might be of interest.

22nd of May, 2008 Belfast VLPS - This Donegal People's Press Report in the Case History of Daniel & Elva Gallagher I suggest as 'required reading' for Jason K & Student 9th May & Student+ 11th May 2008 Donegal People's Press, 22nd November 2005. · An attempt by three Donegal women to prevent Bord Failte proceeding a fraud claim for an International Fund for Ireland (IFI) grant against them has failed. · The 1993 IFI grant was for a 'multi-activity tourist centre' for the sum of 83,000 Euros was allegedly used to build a private house. Four years later an action was taken against Castlefin Multi-Activity Holiday Centre Ltd. Catherine Doherty and her estranged husband Daniel Doherty, their daughters Siobhan and Paula Mary and Sean McGlynn solicitor. · Last Wednesday, Mr. Justice Daniel Herbert remarked that the Bord Failte claims regarding the "sham" were warranted and some or not all of the defendants had conspired to deceive the money. Mr. McGlynn who practised as Sean McGlynn and Co. had issued a certificate of good marketable title to certain lands knowing that Bord Failte would rely on that. When it was stated in open court that Solicitor Sean McGlynn had 'deprived' Madge Friel of her money in the last 'seven years' of her life in Ballindrait nursing home, Solicitor Sean McGlynn was reduced to 'shrugging' his wee shoulders. If a 'petty thief' had stolen, e.g. £20 from Madge Friel they may well have been jailed by Judge John O'Hagan. Solicitor Sean McGlynn can 'deprive/steal' over one hundred thousand pounds from Madge Friel and he isn't even reprimanded by Judge John O'Hagan. Is it the case that solicitors are above the law? Or! Judge John O'Hagan is the perfect example and a living proof of why a watchdog is needed to monitor the Judiciary and the only permanent solution is to have properly trained and mentally stable people appointed to the Bench. Judge John O'Hagan alone has cost this country an enormous amount of money because of his neverending efforts in trying to cover up to save the hide of fraudsters like McGlynn, and it does not appear that he will cop on until he is forced to do so. And for you who are watching and reading this site, Judge O'Hagan is facing seven more damning situations and four others who are trying to make up their minds or to overcome their fear and speak out.

17th of Nov, 2008 Derry VLPS Some interesting snippets here. It is a STRICT rule of law in Ireland that NO witness to a Will can benefit from that Will. Mrs. Friel had also executed a Power of Attorney in favour of my husband, Sean McGlynn, in order that he could make the necessary arrangements with the Ulster Bank, Letterkenny, for payment of the fees which had to be paid for her upkeep in the Lagan Valley nursing home in addition to the pension she was receiving, which pension was paid directly to the Lagan Valley nursing home. No monies, other than those paid to the Lagan Valley nursing home were withdrawn from Mrs. Friel's bank accounts. Mrs. Friel, although fully lucid and capable at the time of the making of her Will, a fact verified by a letter from her attending Doctor, eventually began to suffer from dementia. Payments were still being made on foot of a standing order from her current account but these funds eventually became depleted. She did have another account which was not accessible on demand and required notice and documentation to be executed by, or on behalf of Mrs. Friel. Because of the fact that she was now incapable of managing her own affairs, the Power of Attorney which she had executed was now of no legal effect and therefore the bank would not accept either the signature of Mrs. Friel or Sean McGlynn to release these funds. Payments to the Lagan Valley nursing home therefore ceased but on the basis of an assurance from Helen McCoy (niece of Mrs. Friel) that any fees due would be paid, Mrs. Ayton, to her credit, agreed to await payment. Catherine would you please ask your husband why 'his pen slipped' and instead of abiding by the 'Strict Rule' that 'A witness cannot be a beneficiary'. I recall it being mentioned in court that 'your husband had written' "I am a beneficiary mysself." "Is this 'A Freudian Slip' the 'Truth Slipping out from the Unconscious Mind' ?? Oh? what 'A Good Honest Guy' your husband is. Not a guy who would operate his business without insurance cover to protect his 'valued clients'. Not a guy who is identified in the statement of Judge Edwards as having 'Enduring Power of Attorney' "Is that another slip of the pen?" When President Richard Nixon was being impeached for his lies the media sound-bite was: "Would you buy a second-hand car from this man?" I would not recommend anyone to buy a second-hand car from your husband Solicitor Sean McGlynn. A person who goes about in business without the proper insurance to protect his clients is a Solicitor who cannot be trusted.

She thinks she can intimidate, if not order people to be quiet. She thinks she can adjust words to influence others. It does appear that this practice did take advantage of the old lady in at least one form. It would be informative to know what the McGlynns charges were in this case. I suspect that extortionate charges are the main grievance here. White collar criminals of the lowest order will take advantage of a situation and produce extortionate orders for services rendered. In most people's view, this action does amount to theft. McGlynns are trying to plead innocence, but their case is dismissed.

I did phone Mr Finnegan back today and listened to him for a considerable length of time and when I discovered that he was the two ends of a dog's dinner I told him to mind his own *** business. 1st of Dec, 2008 Tyrone VLPS to John Finnegan I have been in the courts in Northern Ireland to support VLPS members in the six counties. I have seen VLPS members cross-examine solicitors and believe it or not, a Church of Ireland minister. In other words, at least the machinations of justice were there for all to see. I have been a few times to support Daniel & Elva Gallagher. There was never any giving of 'oral evidence' under oath and no cross-examination. In the High Court sham hearing, Justice Edwards contorted himself into such a position that he had his back to Elva Gallagher and was looking over his shoulder. On this occasion, not a single shred of oral evidence or cross-examination. Perhaps Catherine McGlynn has a different version as she appears to have been present at all these court appearances and is able to provide details in her blog.

If it wasn't so serious, it could be described as a joke, as the 'Multi-Activity Centre' at Castlefin, Co Donegal against which grants from Bord Failte were drawn is nothing other than a 'brand spanking new detached house' that doesn't even have a driveway from the road. You would think the house actually grew out in the middle of the field. Very strong fertiliser in Donegal, especially of the 'mushroom' variety when Solicitor Sean McGlynn is involved in the 'Cultivation/Corruption'. 9th of Dec, 2008 Donegal VLPS I believe this legal snippet from the Attorney General may be important: "SUCCESSION ACT 1965 RESTATEMENT Certified by the Attorney General on 18 May 2004 under section 2(1) of the Statute Law (Restatement) Act 2002 (No. 33 of 2002) to be a statement of the law contained in the Succession Act 1965. Partial intestacy. [s. 74: 27/1965] Where the will of a testator effectively disposes of part only of his estate, the remainder shall be distributed as if he had died intestate and left no other estate." Catherine McGlynn, who got Madge Friel's gold watch? It would appear from this restatement of the Succession Act by the Attorney General that as there was no Residue Clause in Madge Friel's will, any property not disposed of specifically in her will must follow the laws of 'partial intestacy'. Only those persons entitled under intestacy can take legal action and not you or your husband Solicitor Sean McGlynn. What is your answer Catherine?

Signed off by Roy Brady, SC, Attorney General. 97. Devise of estate tail not to lapse where inheritable issue survives. [s. 97: 27/1965] Where a person to whom real estate is devised for an estate tail or an estate in quasi entail dies in the lifetime of the testator leaving issue who could inherit under the entail, and any such issue is living at the time of the death of the testator, the devise shall not lapse, but shall take effect as if the death of that person had happened immediately after the death of the testator, unless a contrary intention appears from the will.’ There is no ‘contrary intention’ in the will of Madge Friel, which is a ‘devise and bequeath in Fee Simple’. The ‘statement of law’ at 97 by the Attorney General states that, ‘the devise shall not lapse’ and therefore Daniel Gallagher as issue of Anton Gallagher is entitled to inherit the land at Knocknabollan. It is suicidal to treat customers with contempt, moreover in the current climate. And all traders in the locality lose out, not just the offending business. I think the townspeople should unite and bear pressure on these firms to answer the basic questions put to them. Otherwise shoppers will draw their own conclusions, and spend their money elesewhere, and rightfully so if they are treated with contempt. Retailers are suffering enough already, without actually sending the public elsewhere. It is only the few cronies after all that are causing everyone trouble, and it is the same in every town. I also believe that the Industrial School revelations, and what the same lack of accountability gave rise to, is fresh in people's minds. So we should act before the situation deteriorates even further. Maybe it is that solicitors don't have to worry as they made so much in the boom, but the rest of us have still to make a living, and competition is increasing all the time, unlike with solicitors who have a monopoly.

Ripping us off and driving business costs through the roof is bad enough, but giving the two fingers to justice is an entirely new level of contempt. Ireland above all cannot as a global economny afford this, and we have the job losses to prove it. I also accept the point on the GAA. If we pay them then that is end end of small clubs, and if we don’t then we risk losing top players to other sports where they get remunerated. The only solution is to take out cartel cost elements of society, and solicitors are at the top of that list for the very obvious reasons outlined here. Refusing to answer the basic questions asked of them does nothing if only to convince us that the McGlynns are hiding something key. E.g. did they enter into a conflict of interests or not? Look at the poor shopkeepers facing rent hikes of 47% in Letterkenny Shopping Centre, while shopping across the border is rampant. Then we have 10 of of GAA county panel unemployed because the state is uncompetitive. I see in The Irish Independent today that the number of cases of theft of client funds has trebled in the recession. So they screw us in the boom and steal from us in hard times. Solicitors will break the country if they are not controlled. This is a verys erious issue and anyone who does not take this site serious is either a solicitor or a complete fool. 'The accused' refusing to address the issues is evidence that all in not in order, hence my avoid rating.

8th of Feb, 2010 Mrs. Norma Jameison I wanted a solicitor to complete the documentation for the sale of my house at Tober, Ballindrait, Lifford, County Donegal. I had already agreed the sale and the couple who were buying my house were very pleased with the price and I was very keen to complete sale as I intended to move away from the area. I called into the office of Solicitor Sean McGlynn on and around July 2003. I explained that I wanted them to attend to the documentation for the sale of my house and to give me the cheques as soon as they were paid in. I wasn’t told what his fees would be. I met Catherine McGlynn and then Sean McGlynn. He took the documents and said he would attend to them right away. I told him I needed a solicitor who can speak Spanish as I was going to Spain and my solicitor in Spain needed a solicitor in Ireland who could also speak Spanish. Solicitor Sean McGlynn said, “my wife speaks Spanish;” and Catherine McGlynn replied, “we have a house in Spain, I learnt Spanish and I can speak Spanish”. I gave them the name of the buyer’s solicitor Mr. Fogarty from Sligo and they agreed to act on my behalf. This sale could not be completed because Mr. Fogarty couldn’t get replies and when he did the information was false, e.g. ‘that there was no main water supply at my house, Tober, Ballindrait, Lifford, County Donegal.’ I got a phone call from the buyer’s wife and she told me that they weren’t proceeding with the sale. Solicitor Sean McGlynn accused me of being nasty to Mr. Fogarty, which again was untrue. I phoned Mr. Fogarty and he agreed that I had always been pleasant. I called into Solicitor Sean McGlynn’s office in and around August 2003 to get my documents back from his office. As I entered the office, I noticed a young couple in tears, pleading to get their money from the sale of their house as they were going to Canada or America for a new life. There were another four people waiting, I asked them were they being seen to and they told me to go ahead. I spoke with Catherine McGlynn and asked for my documents back. She said, “you are not getting the documents”. I said, “I do not trust you any more as I have already lost the sale of my house”. Catherine McGlynn accused me of harassment and said she would get the Gardai for me. This caused me great fear. Solicitor Sean McGlynn then shouted, “give her the documents and charge her 270 Euro”. I was going over to talk to Solicitor Sean McGlynn and he shouted! “Don’t put your hands on me”! “Don’t touch me, I will charge you with assault.” I replied, “I wouldn’t want to get my hands dirtied, I only came here for my documents, as you did nothing for me.” The other four people had left and Catherine McGlynn accused me of losing them clients. I said, “you did that yourself” I found Catherine McGlynn and Solicitor Sean McGlynn to be both as ‘bad as each other’ and I was very scared and I was also very upset. I paid over the 270 Euro, which Solicitor Sean McGlynn said was for storing my documents in his safe. I am still saddened when I think of the young couple in tears pleading for their money. I hope the young couple finally got their money to go abroad to America or Canada for a new life.

I am not informed of all the facts on either the Bord Failte matter or the matter of the late Mrs Friel as I have not read all the court papers or judgments. Incidentally, if you haven't read them you are not informed of the facts either. What has sickened me is that people appear to be using this forum as a means of venting personal vendettas against Catherine McGlynn pointedly attacking her appearance and calling her among other things, a 'Big-Mouth' a 'Cow' saying she looks old and the worst calling her 'Mr Blobby.' This is not a hate site, this is a review of a solicitor and his professional capability. Those of you who have resorted to the lowest common denominator of name-calling and anti-English sentiment are showing yourselves to be ignorant. By all means state the facts of the legal matters concerned, the FACTS, but see sense and stop attacking the appearance of the man's wife. Ridiculous.

I don't think personal remarks are appropriate but they do not take from the fact that McGlynn knowingly entered into a gross conflict of interests, and for that his word cannot be taken. He would not be allowed to practice as a lawyer in any democracy exccept Ireland. Why, I don't know. Is it also true that in another case him and his beautiful wife acted as Solicitor and Executor in a significant estate, and then went on to receive the proceeds of the estate. I cannot understand why they have adopted a blasé attitude to the Court ~ One would have to be blind and cognitively impaired to fail to realise that the bequests of the old women have dwindled away with this company in charge of things. One watches and awaits a good outcome by the Irish Supreme Court in these matters having secured a detailed discovery underpining all facts of the matter. Failing this I'm afraid I can envisage little choice for the Gallagher family but to bring their plight to Europe and embarrass and expose the clanish incompetence of the Irish legal system. And by reading I am assured this IS indeed what they are making plans for. Would they have had a better hearing under the Crown one questions? Best wishes.
